Agreement to Terms

By accessing or using Akademiq's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Description of Service

Akademiq provides a cloud-based institute management platform designed for coaching centers, tuition institutes, and training centers in India. The Service includes student management, attendance tracking, fee management, certificate generation, parent portals, and related features.

User Accounts

Account Creation

To use the Service, you must create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your account credentials
• Promptly update account information as necessary
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

Eligibility

You must be at least 18 years old and legally able to enter into contracts to use this Service. By using Akademiq, you represent that you meet these requirements.

Subscription and Payment

Subscription Plans

Akademiq offers various subscription plans (Free, Starter, Growth, Pro) with different features and limitations. Plan details and pricing are available on our pricing page.

Payment Terms

• Subscription fees are billed monthly or annually in advance
• All fees are in Indian Rupees (INR) unless otherwise stated
• Payment is due immediately upon subscription or renewal
• We accept UPI, credit/debit cards, net banking, and other payment methods as displayed
• You authorize us to charge your chosen payment method for subscription fees

Taxes

All fees are exclusive of applicable taxes. You are responsible for paying all taxes associated with your use of the Service, including GST and any other applicable Indian taxes.

User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Comply with all applicable laws and regulations
• Not use the Service to transmit harmful content or malware
• Not attempt to gain unauthorized access to the Service or systems
• Not interfere with or disrupt the Service
• Not use automated systems to access the Service without permission
• Maintain appropriate consent from students and parents for data collection
• Comply with applicable data protection and privacy laws

Data and Content

Your Data

You retain ownership of all data you input into the Service (student records, attendance, fees, etc.). You grant us permission to use, store, and process this data solely to provide the Service. You are responsible for ensuring you have the necessary rights and consents to use and share this data.

Our Rights

Akademiq retains all rights to the Service, including its features, functionality, and underlying technology. You may not copy, modify, distribute, or create derivative works based on the Service.

Data Backup

While we maintain regular backups, you are responsible for maintaining your own backup copies of important data. We are not liable for any loss of data due to technical failures or other circumstances.

Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from Service unavailability.

Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes. Continued use of the Service after modifications constitutes acceptance of the changes.

Termination

By You

You may cancel your subscription at any time through your account settings. Cancellation will be effective at the end of your current billing period. No refunds are provided for partial subscription periods unless required by law.

By Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in fraudulent or harmful activities. We will provide notice when reasonably possible.

Effect of Termination

Upon termination, your access to the Service will cease. You may request a data export within 30 days of termination, after which we may delete your data in accordance with our data retention policies.

Limitation of Liability

To the maximum extent permitted by law, Akademiq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Indemnification

You agree to indemnify and hold harmless Akademiq and its affiliates from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of India.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
